Welcome to Elite Custom Fabrication Worx. By accessing or purchasing from our website, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

2. Products and Services

  1. We offer steel products including, but not limited to:

    • Garden edging

    • Decorative steel signs and landscape art

    • Custom-made steel designs

    2. All products are subject to availability and may vary slightly from descriptions or images.

    3. Custom Orders

    3.1 Custom-made products are manufactured based on customer-provided designs, specifications, or instructions.

    3.2 By submitting a design, you confirm that:

    • You have the right to use the design

    • The design does not infringe on any third-party intellectual property

    3. 3.3 Dimensions and Tolerances

    Due to the nature of steel fabrication and custom production:

    • Final dimensions may vary slightly from requested measurements

    • Minor variations, tolerances, and finish differences are inherent in the manufacturing process

    • Elite Custom Fabrication Worx is not liable for such variations

    4. 3.4 Once production has commenced, custom orders cannot be modified, cancelled, or refunded.

    4. Pricing and Payment

    4.1 All prices are listed in AUD (unless stated otherwise) and include GST where applicable.

    4.2 Payment must be made in full before order processing unless otherwise agreed.

    4.3 We reserve the right to change pricing at any time without notice.

    5. Order Acceptance

    5.1 All orders are subject to acceptance by us.

    5.2 We reserve the right to refuse or cancel any order at our discretion, including due to errors in pricing or product descriptions.

    6. Production and Lead Times

    6.1 Estimated production and delivery times are provided as a guide only.

    6.2 Delays may occur due to material availability, workload, or external factors.

    6.3 We are not liable for any loss or damage resulting from third party handling.

    7. Shipping and Delivery

    7.1 Shipping costs are calculated at checkout or quoted separately.

    7.2 Risk and responsibility of loss or damage of each product passes to the customer upon dispatch.

    7.3 It is the customer’s responsibility to ensure safe access for delivery.

    7.4 Any delivery issues must be reported within 2 business days after arrival of product.

    8. Returns and Refunds

    8.1 Custom Orders

    Custom-made products are non-refundable and non-returnable unless defective from production.

    8.2 Standard Products

    • Returns may be accepted within 14 days if unused and in original condition

    • Return shipping costs are the responsibility of the customer

    5. 8.3 Refunds will be processed after inspection of returned goods.

    9. Product Use and Installation

    9.1 Customers are responsible for ensuring products are suitable for their intended use.

    9.2 Installation must be carried out safely and in accordance with any provided instructions.

    9.3 We are not liable for damage, injury, or loss arising from incorrect installation or misuse.

    10. Limitation of Liability

    To the maximum extent permitted by law:

    • We are not liable for indirect, incidental, or consequential damages

    • Our liability is limited to the purchase price of the product

    6. Nothing in these Terms excludes rights under Australian Consumer Law.

    11. Warranty

    We warrant that our products are free from manufacturing defects at the time of delivery.

    This warranty does not cover:

    • Normal wear and tear

    • Corrosion due to environmental conditions

    • Improper handling or installation

    7. 12. Intellectual Property

    All designs, images, and content on this website remain the property of Elite Custom Fabrication Worx and may not be used without permission.

    13. Privacy

    We collect and use personal information in accordance with our Privacy Policy.

    14. Governing Law

    These Terms and Conditions are governed by the laws of Victoria, Australia.

    15. Amendments

    We reserve the right to update these Terms and Conditions at any time. Changes will be effective upon posting to the website.
